ISDA letter on EMIR review, Finfrag delay and EFET letter on energy market interventions

ISDA has written this open letter to the European Commission, ESMA and others in relation to the different reviews taking place with respect to EMIR. There are 12 recommendations, which include commentary on the proposed changes to the EMIR commodities clearing threshold (see here) as well as a recommendation to partially implement single sided reporting. The date for EMIR REFIT in relation to reporting was recently announced (see here).

In Switzerland, the start of reporting for entities in scope of the FMIA (“Finfrag”) regulation that have “NFC-” status has again been delayed until the beginning of 2028 (see here). The regulation is similar to EMIR and others worldwide.

EFET has published this open letter in related to the EU level energy market regulations published in the Official journal last week (see here). The comments span items such as how to calculate “market revenue” as well as suggesting efficiencies in reporting.
